The terms for using the MyTrial website and learning with MyTrial Academy. Clear expectations for accounts, courses and credentials.

01About these terms

These Terms govern your use of the MyTrial public website and MyTrial Academy, operated by MyTrial Inc. (“MyTrial,” “we,” “us”). Academy provides clinical research education, learning records and related credential services. These are the shared Terms for those services.

Review these Terms before creating an account or making a purchase. An order or organization agreement that you separately accept may contain additional terms; those specific terms control any conflict for that order or organization service. These Terms apply prospectively. They do not retroactively change an existing account agreement or purchase unless validly amended. A reference to a future service is not a commitment to a launch date, feature or availability.

02Eligibility and your account

You must be at least 16 to use Academy. If you have not reached the age of legal majority where you live, a parent or guardian must review and agree to these Terms and permit your use. You must be able to enter into the relevant agreement, or have that required permission.

Provide accurate account information, keep it current, protect your credentials and use only accounts you are authorized to use. Do not share a personal learner login or impersonate another person. Contact us if you suspect unauthorized access. If you act for an organization, you must have authority to do so; organization membership does not automatically grant every course, seat or credential entitlement.

03Education and credentials

Academy content is for education and general information. It is not individualized medical, legal or regulatory advice, diagnosis or treatment. It does not replace your professional judgment, your organization’s procedures, or advice from an appropriately qualified professional. Do not use our contact form for an emergency; contact local emergency services.

Course and track credentials document completion under the requirements shown for that offering. They are not professional licenses, authorization to practice, employment guarantees, or a guarantee that a sponsor, employer, institution or regulator will accept a particular training record. Check the recipient’s requirements and any stated validity or renewal period.

Complete assessments honestly. We may investigate suspected cheating, impersonation, falsified records or credential misuse and correct or revoke records when justified. We aim to keep learning material useful and accurate, but errors may occur. Any available AI study assistance can produce inaccurate or incomplete answers; verify information before relying on it.

04Purchases, billing and cancellation

The offer and checkout identify what you are buying, the price and currency, applicable taxes, included access and any duration or renewal terms. A one-time purchase does not become a recurring subscription without separate authorization. If an offer is recurring, its billing frequency, renewal terms and cancellation method must be disclosed when you subscribe.

Use the available billing controls or contact us for billing help, cancellation requests or suspected errors. Cancel a subscription before the next renewal to avoid the next charge, subject to the terms disclosed for the offer and applicable law. A cancellation generally affects future renewals; access through a paid period follows your offer. Deleting a personal account does not necessarily cancel a separately administered organization subscription.

Unless an offer states otherwise or the law requires it, completed digital purchases and charges for an already-started service period are not refundable merely because you change your mind or do not complete a course. This does not limit remedies for duplicate or unauthorized charges, non-delivery, defective services, or other mandatory consumer rights. Contact us about a problem so we can investigate it.

Any statutory cancellation, withdrawal or refund rights remain available. Where immediate supply of digital content requires a separate express consent and acknowledgment to affect a withdrawal right, these Terms alone do not provide that consent or acknowledgment. Nothing here restricts a good-faith billing dispute.

05Permitted use and intellectual property

Subject to your applicable access rights, you may use Academy materials for your own learning and use issued credentials to accurately represent your completion. MyTrial and its licensors retain rights in the service, software, branding and course materials. Do not resell, redistribute or publish restricted learning or assessment materials without permission, except where the law permits it.

Do not use the services for fraud, harassment, unlawful content, spam, credential forgery, assessment cheating, unauthorized access, attempts to defeat security controls, or activity that disrupts the service. Do not upload malware or patient records, or disclose someone else’s confidential information without authority.

You retain ownership of material you submit. You give us permission to host, process, display and transmit that material only as needed to provide the service you request, operate its features and address support or legal obligations. This permission does not transfer ownership or override our Privacy Policy.

06Profiles, verification and organizations

You are responsible for the accuracy and lawfulness of profile content you publish. Public profiles may be visible to others and search engines. Credential-verification pages may display your name, course or track, credential identifier, issue date and expiration date. Do not imply an endorsement or qualification you have not earned.

When you use organization training, authorized organization staff may see relevant membership and training records. Your personal account, organization membership, purchased access and issued credentials have distinct roles. Account closure may not remove historical issued-credential verification records or records lawfully retained by an organization. Contact us about corrections or privacy requests.

07Privacy and communications

Our Privacy Policy explains collection, use, sharing, retention and your choices. Acknowledging these Terms or the Privacy Policy does not replace separate consent required for optional analytics, marketing or other optional uses. You can manage browser choices in Consent Preferences and account choices in the Academy privacy center.

We may send communications necessary to administer your account, purchases, learning records, security or requests. Marketing choices are separate. Do not include sensitive patient information in support communications.

08Changes, suspension and third parties

We may maintain, update or modify the service. Access may be interrupted by maintenance, faults or events outside our control. We may reasonably restrict or suspend access to investigate misuse, protect users or comply with law. Where appropriate and lawful, we will explain the reason and provide a way to contact us. Changes or suspension do not remove remedies or purchased rights that the law requires us to honor.

Third-party sites and services, including payment and sign-in services, have their own applicable terms. Links do not imply endorsement. You may stop using the services at any time; use the appropriate cancellation controls for recurring purchases and the privacy center for account deletion.

09Warranties and responsibility

To the extent permitted by law, the website and Academy are provided on an “as available” basis without a promise of uninterrupted or error-free operation, fitness for a particular professional requirement, or a particular learning or employment outcome. Mandatory warranties and consumer protections remain in effect.

To the extent permitted by law, MyTrial is not responsible for indirect or consequential losses arising from use of the services, such as lost profits or business opportunities. Nothing in these Terms excludes or limits responsibility for fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, or any responsibility that cannot lawfully be excluded or limited.

You remain responsible for your own unlawful acts and misuse of the services. These Terms do not require you to waive a right or remedy that applicable law protects.

10Questions, complaints and governing law

Please first contact info@mytrial.com or our contact form with a concern so we can try to resolve it. This does not prevent you from making a lawful claim, raising a billing dispute or contacting a regulator.

California law governs these Terms, except where applicable law requires otherwise. Mandatory protections and rights available in your place of residence continue to apply, including any right to bring a claim in a legally available forum.

11Updates to these terms

We may update these Terms prospectively. The date above identifies this version. We will provide notice of material changes and obtain renewed agreement where required. Changes do not retroactively remove accrued rights or mandatory remedies. If a provision cannot be enforced, the remaining provisions continue to apply to the extent permitted by law.
