In the previous lesson, we traced the ethical arc from Nuremberg to ICH E6(R3) -- the moral foundations that explain why informed consent exists. This lesson turns from philosophy to architecture. We are going to read the blueprint.
ICH E6(R3), Annex 1, Section 2.8 is the single most important regulatory text governing informed consent in international clinical trials. It is not long -- roughly four pages in the published guideline. But within those four pages sits the complete framework: procedural requirements that dictate how consent must be obtained, 22 required disclosure elements that dictate what participants must be told, and special-situation provisions that address populations and circumstances where the standard process cannot apply.
I have taught this material for years, and I will tell you plainly: most practitioners have never read Section 2.8 in its entirety. They know the consent form. They know the general idea. But they have not sat with the actual regulatory text and traced each requirement to its purpose. That is what we are about to do.
